Bienvenue chez Animus Forge ! Les termes « nous », « notre » et « nos » désignent Animus Forge. Animus Forge exploite cette boutique et ce site web, y compris l’ensemble des informations, contenus, fonctionnalités, outils, produits et services associés, afin de vous offrir, en tant que client, une expérience d’achat personnalisée (les « Services »). Animus Forge utilise la plateforme Shopify, qui nous permet de vous proposer les Services.
Les conditions générales ci-dessous, ainsi que les politiques qui y sont référencées (les « Conditions d’utilisation » ou « CU »), décrivent vos droits et responsabilités lorsque vous utilisez les Services.

ARTICLE 1 - ACCÈS ET COMPTE
En acceptant les présentes Conditions d’utilisation, vous déclarez avoir atteint l’âge de la majorité légale dans votre État ou province de résidence et vous nous donnez votre consentement pour autoriser vos enfants mineurs à utiliser les Services sur les appareils que vous possédez, achetez ou gérez.
Pour utiliser les Services, y compris pour accéder à ou parcourir nos boutiques en ligne ou pour acheter l’un
des produits ou services que nous proposons, il peut vous être demandé de fournir certaines informations, telles que votre adresse e-mail, vos informations de facturation, de paiement et de livraison. Votre commande n’est considérée comme acceptée qu’après confirmation écrite de Animus Forge. Nous devons recevoir et traiter votre paiement avant que votre commande ne soit validée. Veuillez vérifier attentivement votre commande avant de la soumettre, car Animus Forge pourrait ne pas être en mesure d’accepter les demandes d’annulation une fois la commande confirmée. En cas de refus, de modification ou d’annulation de votre commande, nous tenterons de vous contacter en utilisant l’adresse e-mail, l’adresse de facturation et/ou le numéro de téléphone fournis lors de la commande.
Vos achats sont soumis aux conditions de retour ou d’échange conformément à notre Politique de remboursement [[LIEN]].
Vous déclarez et garantissez que vos achats sont destinés à un usage personnel ou domestique, et non à la revente commerciale ou à l’exportation.

ARTICLE 4 - PRIX ET FACTURATION
Les prix, réductions et promotions sont susceptibles d’être modifiés sans préavis. Le prix facturé pour un produit ou un service sera celui en vigueur au moment de la commande et sera indiqué dans l’e-mail de confirmation de votre commande. Sauf mention contraire expresse, les prix affichés n’incluent pas les taxes, frais de livraison, frais de préparation, droits de douane ou frais d’importation.
Les prix affichés sur nos boutiques en ligne peuvent différer de ceux proposés dans nos magasins physiques ou sur d’autres plateformes en ligne exploitées par des tiers. Nous pouvons proposer, de temps à autre, des promotions sur nos Services qui peuvent impacter les prix et qui sont régies par les conditions générales, distinctes des présentes Conditions. En cas de conflit entre les conditions d’une promotion et les présentes Conditions, les conditions de la promotion prévaudront.
Vous acceptez de fournir les informations actuelles d’achat, de paiement et de compte, complètes et exactes pour tous les achats effectués dans nos boutiques. Vous vous engagez à mettre à jour rapidement vos informations, y compris votre adresse e-mail, vos numéros de carte de crédit et leurs dates d’expiration, afin que nous puissions finaliser vos transactions et vous contacter si nécessaire.
Vous déclarez et garantissez que : (i) les informations de votre carte de crédit sont exactes, correctes et complètes, (ii) vous êtes autorisé(e) à utiliser cette carte pour l’achat, (iii) les frais engagés seront honorés par la société émettrice de votre carte, et (iv) vous paierez les frais engagés aux prix affichés, y compris les frais de livraison et de traitement, ainsi que toutes les taxes applicables.

ARTICLE 5 - EXPÉDITION ET LIVRAISON
Nous ne pouvons être tenus responsables des retards de livraison ou d’expédition. Tous les délais de livraison indiqués sont des estimations et ne sont pas garantis. Nous déclinons toute responsabilité pour les retards causés par les transporteurs, les formalités douanières ou tout événement échappant à notre contrôle. Dès que les produits sont remis au transporteur, la propriété et les risques de perte vous sont transférés.

ARTICLE 6 - PROPRIÉTÉ INTELLECTUELLE

Vous n’êtes pas autorisé(e) à reproduire, distribuer, modifier, créer des œuvres dérivées, afficher publiquement, exécuter publiquement, republier, télécharger, stocker ou transmettre tout document présent sur les Services sans notre accord écrit préalable. Sauf disposition expresse contraire dans les présentes Conditions, rien ne doit être interprété comme vous accordant une licence ou tout autre droit sur un quelconque brevet, marque, droit d’auteur ou autre propriété intellectuelle de Animus Forge, de Shopify ou d’un tiers. Toute utilisation non autorisée des Services peut constituer une violation des lois fédérales et des États sur la propriété intellectuelle. Tous les droits non expressément accordés dans les présentes Conditions sont réservés par Animus Forge.
Les noms, logos, noms de produits et de services, designs et slogans de Animus Forge sont des marques déposées de Animus Forge, de ses filiales ou de ses concédants de licence. Vous ne pouvez les utiliser sans l’autorisation écrite préalable de Animus Forge. Le nom, le logo, les noms de produits et de services, les designs et les slogans de Shopify sont des marques déposées de Shopify. Tous les autres noms, logos, noms de produits et de services, designs et slogans présents sur les Services sont les marques déposées de leurs propriétaires respectifs.

ARTICLE 7 - OUTILS OPTIONNELS
Vous pouvez être amené(e) à utiliser des outils clients proposés par des tiers dans le cadre des Services, outils que nous ne surveillons pas et sur lesquels nous n’avons aucun contrôle ni possibilité de contribuer.
Vous reconnaissez et acceptez que nous fournissons l’accès à ces outils « en l’état » et « selon disponibilité », sans garantie, déclaration ou condition d’aucune sorte, et sans approbation de notre part. Nous déclinons toute responsabilité découlant de ou liée à votre utilisation d’outils tiers optionnels.
L’utilisation des outils optionnels proposés sur le site se fait sous votre entière responsabilité et à votre seule discrétion. Il vous incombe de vous assurer que vous connaissez et acceptez les conditions applicables à ces outils, telles que définies par le ou les fournisseurs tiers concernés.
Nous pourrons également, à l’avenir, proposer de nouvelles fonctionnalités via les Services (y compris la mise à disposition de nouveaux outils et ressources). Ces nouvelles fonctionnalités seront considérées comme faisant partie intégrante des Services et seront soumises aux présentes Conditions d’utilisation.

Les Services peuvent contenir des documents et des liens hypertextes vers des sites web fournis ou exploités par des tiers (y compris des fonctionnalités tierces intégrées). Nous ne sommes pas responsables de l’examen ou de l’évaluation du contenu ou de l’exactitude des documents ou sites web tiers auxquels vous choisissez d’accéder. Si vous décidez de quitter les Services pour accéder à ces documents ou sites tiers, vous le faites à vos propres risques.
Nous déclinons toute responsabilité en cas de préjudice ou dommage lié à votre accès à des sites web tiers, ou à l’achat ou l’utilisation de produits, services, ressources ou contenus sur ces sites. Nous vous invitons à examiner attentivement les politiques et pratiques des tiers et à vous assurer de les comprendre avant d’effectuer toute transaction. Les réclamations, plaintes, préoccupations ou questions concernant les produits et services de tiers doivent être adressées directement au tiers concerné.

ARTICLE 9 - RELATION AVEC SHOPIFY

Animus Forge est propulsé par Shopify, ce qui nous permet de vous proposer les Services. Cependant, toute vente ou tout achat effectué dans notre Boutique est réalisé directement avec Animus Forge. En utilisant les Services, vous reconnaissez et acceptez que Shopify ne soit responsable d’aucun aspect des ventes entre vous et Animus Forge, y compris tout dommage, préjudice ou perte résultant des produits ou services achetés. Par la présente, vous dégagez expressément Shopify et ses filiales de toute réclamation, de tout dommage et de toute responsabilité découlant de ou liés à votre achat et à votre transaction avec Animus Forge.

ARTICLE 10 - POLITIQUE DE CONFIDENTIALITÉ

Étant donné que les Services sont hébergés par Shopify, Shopify collecte et traite des informations personnelles concernant votre accès et votre utilisation des Services afin de vous les fournir et de les améliorer. ARTICLE 11 - RETOURS D’EXPÉRIENCE
Si vous soumettez, téléchargez, publiez, envoyez par e-mail ou transmettez autrement des idées, suggestions, retours d’expérience, avis, propositions, plans ou tout autre contenu (collectivement, « Retours d’expérience »), vous nous accordez une licence perpétuelle, mondiale, sous-licenciable et non exclusive pour utiliser, reproduire, modifier, publier, distribuer et afficher ces Retours à toute fin, y compris à des fins commerciales. Nous pouvons, par exemple, utiliser nos droits en vertu de cette licence pour exploiter, fournir, évaluer, améliorer et promouvoir les Services et pour remplir nos obligations et exercer nos droits en vertu des Conditions d’utilisation.
Vous déclarez et garantissez également que : (i) vous êtes titulaire ou disposez de tous les droits nécessaires sur les Retours d’expérience ; (ii) vous avez communiqué toute compensation ou incitation reçue en lien avec la soumission de vos Retours d’expérience ;(iii) vos Retours d’expérience respectent les présentes Conditions. Nous ne sommes et ne serons tenus d’aucune obligation (1) de maintenir la confidentialité de vos Retours d’expérience ;(2) de verser une compensation pour vos Retours d’expérience ;(3) de répondre à vos Retours d’expérience.
Nous pouvons, sans y être tenus, surveiller, modifier ou supprimer tout Retour d’expérience que nous jugeons, à notre seule discrétion, illégal, offensant, menaçant, diffamatoire, calomnieux, pornographique, obscène ou autrement répréhensible, ou qui enfreint les droits de propriété intellectuelle d’une partie ou les présentes Conditions de service.
Vous vous engagez à ce que vos Retours d’expérience ne portent atteinte à aucun droit de tiers, y compris les droits d’auteur, marques, protection des données, droits de la personnalité ou autres droits personnels ou patrimoniaux. Vous vous engagez, en outre, à ce que vos Retours d’expérience ne contiennent aucun propos diffamatoire, illégal, abusif ou obscène, ni aucun virus informatique ou logiciel malveillant susceptible d’affecter le fonctionnement des Services ou de tout site web connexe. Il vous est interdit d’utiliser une adresse électronique falsifiée, de vous substituer à autrui ou de nous induire en erreur, ainsi que des tiers, sur l’origine des Retours d’expérience. Vous êtes seul responsable de vos Retours d’expérience et de leur exactitude. Nous déclinons toute responsabilité et ne saurions être tenus pour responsables des Retours d’expérience publiés par vous ou par un tiers.

ARTICLE 12 - ERREURS, INEXACTITUDES ET OMISSIONS
Les Services peuvent occasionnellement contenir des informations présentant des erreurs typographiques, des inexactitudes ou des omissions, notamment concernant les descriptions de produits, les prix, les promotions, les offres, les frais de livraison, les délais de transit ou la disponibilité des produits. Nous nous réservons le droit de corriger toute erreur, inexactitude ou omission, ainsi que de modifier ou de mettre à jour les informations ou d’annuler les commandes en cas d’information inexacte, et ce à tout moment et sans préavis (y compris après la soumission de votre commande).

ARTICLE 13 - UTILISATIONS INTERDITES
Vous ne pouvez accéder aux Services et les utiliser qu’à des fins licites. Il vous est strictement interdit d’accéder aux Services ou de les utiliser, directement ou indirectement : (a) à des fins illicites ou malveillantes ; (b) en violation de toute réglementation, règle, loi internationale, fédérale, provinciale, d’État ou locale ; (c) de manière à porter atteinte aux droits de propriété intellectuelle de Animus Forge, de Shopify ou de tiers ; (d) pour harceler, abuser, insulter, nuire, diffamer, calomnier, dénigrer, intimider ou porter préjudice à l’un de nos employés ou à toute autre personne ; (e) pour transmettre des informations fausses ou trompeuses ; (f) pour envoyer, recevoir sciemment, télécharger, utiliser ou réutiliser tout contenu non conforme aux présentes Conditions ; (g) pour transmettre ou provoquer l’envoi de tout matériel publicitaire ou promotionnel, y compris des « pourriels », « chaînes de lettres », « courriers indésirables » ou toute autre sollicitation similaire ; (h) pour usurper l’identité d’une personne ou d’une entité, ou tenter de le faire ; (i) pour adopter tout comportement susceptible de restreindre ou d’entraver l’utilisation ou la jouissance des Services par autrui, ou qui, selon notre appréciation, pourrait nuire à Animus Forge, à Shopify, aux utilisateurs des Services ou les exposer à une responsabilité quelconque.
De plus, vous vous engagez à ne pas : (a) télécharger ou transmettre des virus ou tout autre code malveillant susceptible d’affecter le fonctionnement ou l’exploitation des Services ; (b) reproduire, dupliquer, copier, extraire, vendre, revendre ou exploiter toute partie des Services ; (c) collecter ou suivre les informations personnelles d’autrui ; (d) recourir à des pratiques de spam, d’hameçonnage (phishing), de pharming ou de prétexte (pretexting) via les Services ; (e) utiliser des robots, araignées (spiders), outils de scraping, de collecte ou d’extraction de données, dispositifs automatisés, outils d’IA (y compris l’IA agentique) ou tout moyen automatisé ou manuel pour accéder aux Services ; (f) interférer avec, contourner ou neutraliser les fonctionnalités de sécurité ou d’autorisation, les en-têtes d’exclusion des robots ou toute autre mesure que nous mettons en place pour restreindre l’accès aux Services. Nous nous réservons le droit de suspendre, désactiver ou résilier votre compte à tout moment et sans préavis si nous déterminons que vous avez violé l’une des dispositions des présentes Conditions.

ARTICLE 14 - AGENTS
14.1 La présente section (« Conditions relatives aux agents ») s’applique si vous utilisez, autorisez, activez ou provoquez le déploiement d’un Agent pour accéder, utiliser ou interagir avec les Services. Un « Agent » désigne tout logiciel ou service agissant de manière autonome ou semi-autonome pour le compte d’une personne ou d’une entité, ou sur instruction de celle-ci, et pouvant être exécuté sur un appareil appartenant à une personne ou utilisé par celle-ci, sans supervision directe.
14.2 Aucun Agent ne peut accéder, utiliser ou interagir avec les Services, sauf s’il s’identifie en permanence et fonctionne en stricte conformité avec les conditions énoncées à la section 14.4 ci-dessous. De plus, aucun Agent ne peut accéder, utiliser ou interagir avec les Services si nous avons demandé à cet Agent de s’abstenir d’accéder, d’utiliser ou d’interagir avec un service quelconque.
14.3 Nous pouvons limiter, y compris par des mesures techniques, la possibilité et la manière dont un Agent accède, utilise et interagit avec les Services.
14.4 Les Agents doivent : (i) dans toutes les requêtes HTTP/HTTPS, indiquer que la requête provient d’un Agent et divulguer le nom de l’Agent en incluant la mention suivante dans la chaîne de l’agent utilisateur : « Agent/[nom de l’agent] » ; (ii) ne pas dissimuler ou masquer le fait que l’accès, l’utilisation ou les interactions proviennent d’un Agent, notamment en (a) imitant un comportement ou des schémas d’interaction humains, ou (b) contournant ou complétant des CAPTCHA ou des mesures destinées à distinguer l’utilisation par un ordinateur de celle par un humain ; (iii) répondre honnêtement à toute question ou invite visant à déterminer si les interactions proviennent d’un humain ou d’un ordinateur ; (iv) ne pas contourner ou éviter toute mesure destinée à bloquer, limiter, modifier ou contrôler l’accès, l’utilisation ou les interactions des Agents avec les Services.

ARTICLE 15 - RÉSILIATION
Nous nous réservons le droit de résilier le présent accord ou votre accès aux Services (ou à toute partie de ceux-ci), à notre entière discrétion, à tout moment et sans préavis. Vous resterez redevable de l’intégralité des montants dus jusqu’à la date de résiliation incluse.
Les articles suivants resteront applicables après toute résiliation : Propriété intellectuelle, Retours d’expérience, Résiliation, Exclusion de garanties, Limitation de responsabilité, Indemnisation, Divisibilité, Renonciation, Intégralité de l’accord, Cession, Loi applicable, Politique de confidentialité, ainsi que toute autre disposition dont la nature implique qu’elle doive survivre à la résiliation.

ARTICLE 16 - EXCLUSION DE GARANTIES
Les informations présentées sur ou via les Services sont mises à disposition à titre purement informatif. Nous ne garantissons pas l’exactitude, l’exhaustivité ou l’utilité de ces informations. Toute confiance que vous accordez à ces informations se fait strictement à vos propres risques. Nous déclinons toute responsabilité et garantie concernant les conséquences découlant de l’utilisation de ces informations par vous-même, tout autre visiteur des Services ou toute personne informée de leur contenu.
SAUF MENTION EXPRESSE DE LA PART DE ANIMUS FORGE, LES SERVICES ET TOUS LES PRODUITS PROPOSÉS PAR LEUR INTERMÉDIAIRE SONT FOURNIS « EN L’ÉTAT » ET « SELON DISPONIBILITÉ » POUR VOTRE UTILISATION, SANS AUCUNE GARANTIE, DÉCLARATION OU CONDITION D’AUCUNE SORTE, EXPRESSE OU IMPLICITE, Y COMPRIS TOUTES LES GARANTIES OU CONDITIONS IMPLICITES DE QUALITÉ MARCHANDE, D’APTITUDE À UN USAGE PARTICULIER, DE DURABILITÉ, DE TITRE DE PROPRIÉTÉ ET DE NON-CONTOURNEMENT DE DROITS. NOUS NE GARANTISSONS PAS QUE VOTRE UTILISATION DES SERVICES SERA ININTERROMPUE, PONCTUELLE, SÉCURISÉE OU EXEMPTE D’ERREURS. CERTAINES JURIDICTIONS LIMITENT OU N’AUTORISENT PAS L’EXCLUSION DES GARANTIES IMPLICITES OU AUTRES, DE SORTE QUE LA PRÉSENTE EXCLUSION PEUT NE PAS VOUS CONCERNER. 

ARTICLE 17 - LIMITATION DE RESPONSABILITÉ
DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI, EN AUCUN CAS ANIMUS FORGE, NOS PARTENAIRES, DIRIGEANTS, ADMINISTRATEURS, EMPLOYÉS, AFFILIÉS, AGENTS, PRESTATAIRES, FOURNISSEURS DE SERVICES OU LICENCIÉS, NI CEUX DE SHOPIFY ET SES AFFILIÉS, NE POURRONT ÊTRE TENUS RESPONSABLES DE TOUT DOMAINE, PERTE, RÉCLAMATION, OU DE TOUT PRÉJUDICE DIRECT, INDIRECT, ACCESSOIRE, EXEMPLAIRE, SPÉCIAL OU CONSÉCUTIF DE QUELQUE NATURE QUE CE SOIT, Y COMPRIS, SANS LIMITATION, LA PERTE DE BÉNÉFICES, DE REVENUS, D’ÉCONOMIES, DE DONNÉES, LES FRAIS DE REMPLACEMENT OU TOUT AUTRE PRÉJUDICE SIMILAIRE, QU’IL SOIT FONDÉ SUR UN CONTRAT, UNE FAUTE (Y COMPRIS LA NÉGLIGENCE), UNE RESPONSABILITÉ STRICTE OU AUTRE, DÉCOULANT DE VOTRE UTILISATION DES SERVICES OU DE TOUT PRODUIT OBTENU VIA LES SERVICES, OU POUR TOUTE AUTRE RÉCLAMATION LIÉE, DE QUELQUE MANIÈRE QUE CE SOIT, À VOTRE UTILISATION DES SERVICES OU DE TOUT PRODUIT, Y COMPRIS, SANS LIMITATION, TOUTE ERREUR OU OMISSION DANS TOUT CONTENU, OU TOUTE PERTE OU TOUT DOMMAGE DE QUELQUE NATURE QUE CE SOIT SUBI À LA SUITE DE L’UTILISATION DES SERVICES OU DE TOUT CONTENU (OU PRODUIT) PUBLIÉ, TRANSMIS OU AUTREMENT MIS À DISPOSITION VIA LES SERVICES, MÊME SI NOUS AVONS ÉTÉ AVERTIS DE LEUR POSSIBILITÉ. 

ARTICLE 18 - INDEMNISATION
Vous vous engagez à indemniser, défendre et dégager de toute responsabilité Animus Forge, Shopify, ainsi que nos affiliés, partenaires, dirigeants, administrateurs, employés, agents, prestataires, concédants et fournisseurs de services, pour toute perte, tout dommage, toute responsabilité ou réclamation, y compris les honoraires raisonnables d’avocats, dus à un tiers et résultant (1) de votre manquement aux présentes Conditions d’utilisation ou aux documents qu’elles intègrent par référence, (2) de votre violation d’une loi ou des droits d’un tiers, ou (3) de votre accès et utilisation des Services.
Nous vous informerons de toute réclamation couverte par cette garantie, sous réserve qu’un défaut de notification rapide ne vous exonère pas de vos obligations, sauf si vous en subissez un préjudice substantiel.
